Atlas Task Manager respects the intellectual property rights of others and expects its users to do the same. This policy explains how to submit a copyright takedown notice or counter-notice under the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
1. Overview
If you believe that material accessible on or through the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. We will respond to valid notices in accordance with the DMCA.
2. Filing a takedown notice
A valid takedown notice must include all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it (e.g., a URL inside the Service).
- Your contact information, including address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.
Knowingly material misrepresentations may subject you to liability under 17 U.S.C. § 512(f).
3. Counter-notice
If you believe your material was removed by mistake or misidentification, you may submit a counter-notice containing:
- Your physical or electronic signature.
- Identification of the material that was removed and its prior location.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district in which your address is located (or, for non-U.S. residents, any judicial district in which we may be found), and that you will accept service of process from the complainant.
If we receive a valid counter-notice, we may restore the material after 10-14 business days, unless the complainant informs us it has filed a court action.
4. Repeat infringer policy
We will, in appropriate circumstances, terminate the accounts of users and account holders determined to be repeat infringers.
